Agreement
These Terms of Use (“Terms”) govern your use of the Watkins Shared Adventures mobile application (the “App”), provided by Watkins Shared Adventures, LLC (“Watkins,” “we,” “us,” or “our”). By downloading or using the App, you agree to these Terms and the App Privacy Policy. If you do not agree, do not use the App.
Travel reservations and participation remain subject to the separate Watkins Shared Adventures travel terms and conditions and any trip-specific or supplier terms.
App license
The App is licensed, not sold. Your App Store download is also subject to Apple’s Standard Licensed Application End User License Agreement. We grant you a limited, personal, nonexclusive, nontransferable, revocable license to use the App on devices you own or control for its intended personal purposes.
Accounts and trip access
You are responsible for the accuracy of information associated with your account and for protecting access to your device and sign-in method. Trip unlock codes and restricted trip materials are intended only for authorized travelers and leaders. You may not publish, sell, share broadly, or misuse an unlock code or another person’s account.
Community conduct
Trip chat and traveler-photo features are shared community spaces. You may not post or transmit content that is unlawful, threatening, harassing, hateful, sexually explicit, fraudulent, invasive of privacy, infringing, malicious, or otherwise harmful. Do not impersonate another person, spam a trip group, expose another traveler’s sensitive information, or interfere with the App.
You retain ownership of content you submit. You grant Watkins a nonexclusive, worldwide, royalty-free license to host, reproduce, display, transmit, resize, and moderate that content only as reasonably necessary to operate, protect, and improve the App and associated trip experience.
Moderation and enforcement
Users may report content and block other users. We may review reports, remove or restrict content, suspend chat access, terminate accounts, or notify appropriate authorities when reasonably necessary to enforce these Terms, protect users, or comply with law. We are not obligated to monitor every message or image before it appears.
App information and notifications
Trip schedules, weather, announcements, and other information may change or be delayed. The App is a convenience and is not a substitute for direct instructions from a trip leader, emergency services, travel documents, or official notices. You are responsible for checking current trip communications. Notification delivery is not guaranteed.
Acceptable use
You may not copy, reverse engineer, disrupt, automate unauthorized access to, introduce malicious code into, or use the App to violate law or another person’s rights, except where a restriction is prohibited by applicable law.
Third-party services
The App may rely on Apple, Google, Firebase, mapping, weather, travel, or other third-party services. Their availability and use may be governed by separate terms. We are not responsible for third-party services outside our control.
Account deletion and termination
You may initiate account deletion under Help → Delete Account. We may suspend or terminate access if you violate these Terms, misuse trip access, threaten safety, or expose the App or its users to risk. Sections that by nature should survive termination—including ownership, disclaimers, limitations, and dispute provisions—will survive.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or noninfringement. Nothing in these Terms limits rights that cannot legally be limited.
To the maximum extent permitted by law, Watkins will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the App. Watkins’ total liability relating solely to the App will not exceed the greater of the amount you paid for the App during the twelve months before the claim or fifty U.S. dollars, except where applicable law requires otherwise.
Changes
We may update the App or these Terms. Material changes will be reflected by the date above and may be communicated in the App when appropriate. Continued use after the effective date means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules, except where the law of your residence requires otherwise.
